  1.                     AGREEMENT TO EXECUTE LEASE
  2.                        AND DEPOSIT RECEIPT 
  3.  
  4. Dated: 12/1/94 
  5. The LANDLORD, Fealty Realty and Nancy Neighbor, the TENANT agree: 
  6.  
  7. In consideration of a deposit of $ 200.00 ( two hundred & no/100
  8. dollars) which shall be credited toward the first month's rent
  9. under a  certain lease described below, and receipt of which is
  10. hereby acknowledged, the parties mutually agree as follows: 
  11.  
  12. The parties shall make, sign, execute and deliver a certain lease 
  13. for the subject premises which is more particularly described as: 
  14.  
  15. Unit A, Castle Apartments  
  16.  
  17.  
  18. The execution and delivery of the lease shall take place on:  
  19. 1/1/95 
  20.  
  21. The LANDLORD shall prepare the lease, which shall contain the 
  22. usual and customary clauses within the community. 
  23.  
  24. In the event of the TENANT's failure to execute the lease, the 
  25. parties agree that the exact amount of damages to be suffered by 
  26. the LANDLORD are difficult to fix, and that upon a breach by the 
  27. TENANT, the LANDLORD shall be entitled to the deposit made as 
  28. liquidated damages, and not as a penalty.
